Artikel 50 Absatz 2 legt die Pflicht zur maschinenlesbaren Kennzeichnung dem ANBIETER des erzeugenden KI-Systems auf, nicht der Webseite, die das Ergebnis veröffentlicht. Haben wir das Bild mit einem eigenen System erzeugt, sind wir Anbieter und die Pflicht trifft uns.

Fires when the asset's origin indicates AI involvement at LIKELY_AI or stronger. Reports that the machine-readable marking duty sits with the PROVIDER of the generating system, not with us as publisher — unless we operated the generating system ourselves.

Fires when there is an indication that provenance metadata existed upstream but is absent from the published file — typically an image-optimisation or CDN pipeline stripping XMP/C2PA. Destroying a provider's marking undermines the regime and destroys our own best evidence.

Fires when the website has no clear EU nexus. Records that the AI Act's territorial reach depends on where the output is used, not on the domain's TLD, and that a low nexus band reduces urgency but never suppresses obligations under other law. Deliberately INFORMATIONAL and action-free: the EU nexus is a property of the WEBSITE, answered once, so it must not raise a finding on every asset that site happens to contain.

Deployers of an AI system that generates or manipulates image, audio or video content constituting a deep fake, shall disclose that the content has been artificially generated or manipulated.

Artikel 50 Absatz 4 verpflichtet Betreiber, künstlich erzeugte oder manipulierte Bildinhalte offenzulegen, die ein Deepfake darstellen. Beide Elemente des Artikels 3 Nr. 60 sind hier erfüllt, daher ist eine sichtbare Kennzeichnung erforderlich.

Fires when BOTH cumulative elements of the Art. 3(60) definition are met: the content is AI-generated or manipulated (origin at LIKELY_AI or stronger) AND it resembles an existing person, object, place, entity or event AND it would falsely appear authentic or truthful. All three conditions must hold; an abstract or evidently stylised asset fails the second and third and does not trigger this rule.

Lässt sich eines der beiden kumulativen Elemente der Deepfake-Definition nicht bestimmen, eskalieren wir, statt in eine Richtung zu raten.

Fires when the asset shows AI involvement and is photorealistic, at least one element of the deep-fake definition could not be determined, AND neither element is definitively absent. Because Article 3(60) requires both elements cumulatively, a definite 'no' on either one rules out a deep fake and this rule must NOT fire — otherwise every undocumented illustration would be escalated to legal review.

Where the content forms part of an evidently artistic, creative, satirical, fictional or analogous work or programme, the transparency obligations set out in this paragraph are limited to disclosure of the existence of such generated or manipulated content in an appropriate manner that does not hamper the display or enjoyment of the work.

Fires when a disclosure duty exists AND the content is evidently artistic, creative, satirical or fictional. Reduces the REQUIRED MANNER of disclosure to unobtrusive. It does NOT remove the duty — this is deliberately modelled as a mode change, never as disclosureRequired: false.

The information referred to in paragraphs 1 to 4 shall be provided to the natural persons concerned in a clear and distinguishable manner at the latest at the time of the first interaction or exposure. The information shall conform to the applicable accessibility requirements.

Fires when a disclosure is required but the asset currently has none. Constrains HOW the disclosure must be made: present at first exposure (so hover-only tooltips fail on touch devices), in the page language, and reachable by assistive technology rather than baked into image pixels.

A commercial practice shall be regarded as misleading if it contains false information or … deceives or is likely to deceive the average consumer …

Ein synthetisches oder ungeprüftes Bild als Dokumentation einer realen Anlage, eines Projekts, eines Teams oder eines Ergebnisses darzustellen, ist geeignet, den Durchschnittsverbraucher zu täuschen. Das gilt unabhängig von der KI-Verordnung und unabhängig vom EU-Bezug.

Fires when a synthetic or unverified image is presented as documentation of something real — a customer installation, a reference project, a team, a testimonial or a result. Independent of the AI Act and independent of EU nexus.

Fires when an image depicts or closely resembles an identifiable natural person and no lawful basis or consent is recorded. UNKNOWN consent on a person-depicting asset is treated as missing, because the absence of a record is itself the finding.

Fires when no licence type and no rights holder are recorded for an asset. For AI-generated assets the relevant licence is the generator's terms of use at the time of generation, which is equally undocumented if not captured.

The AI Office shall encourage and facilitate the drawing up of codes of practice at Union level to facilitate the effective implementation of the obligations regarding the detection and labelling of artificially generated or manipulated content.

Fires for AI-involved assets whose functional class is abstract, decorative or functional (icon, logo, diagram, infographic, abstract illustration, background) AND which are not photorealistic AND which depict no real person, place or event. Suppresses the visible-disclosure recommendations from AIA-50-4, AIA-50-5 and POL-VOLUNTARY-DISCLOSURE, leaving documentation only. Such assets do not resemble an existing subject within Art. 3(60), so no legal duty is being suppressed.

Where an AI-generated image is photorealistic, we disclose it even where no legal duty applies.

Every published asset has a recorded origin. 'Unknown' is an acceptable answer only until someone has looked.

All non-text content that is presented to the user has a text alternative that serves the equivalent purpose.

WCAG 2.2 Erfolgskriterium 1.1.1 verlangt eine Textalternative mit gleichwertigem Zweck. Das ist auch für Artikel 50 Absatz 5 relevant, der Barrierefreiheit der Kennzeichnung verlangt.

Fires when an informative image has a missing, empty or placeholder alt attribute on at least one placement. Decorative images with a deliberately empty alt are correct and do not fire. Also relevant to Art. 50(5), which requires disclosures to meet accessibility requirements.

Artikel 50 Absatz 4 richtet sich an Betreiber eines KI-Systems, das Inhalte erzeugt oder manipuliert. Ob ein Veröffentlichender, der ein bereits erzeugtes Bild lediglich lizenziert hat, ein solcher Betreiber ist, ist ungeklärt. Eine weite Lesart erfasst jeden Veröffentlichenden, eine enge nur denjenigen, der das System betrieben hat. Wir entscheiden das nicht — der Fall geht in die Rechtsprüfung.

It is unsettled whether a publisher who did not operate the generating system is a 'deployer' within Art. 50(4). Both readings are presented to the reviewer; the case is routed to legal review rather than decided here.

Fires when a purely AI-generated asset carries a copyright notice. Output without sufficient human creative input may not attract copyright protection, so asserting '©' over it can itself be a misleading statement. This is our reading of an unsettled area, not settled law.
